TERMS OF SALES
1.1. The sale of products by DROGHERIA CRIVELLINI SRL, concluded remotely through this website (hereinafter referred to as the "Website"), is governed by the following General Sales Conditions.
The products offered on the Website are sold directly by DROGHERIA CRIVELLINI SRL (hereinafter referred to as DROGHERIA CRIVELLINI). DROGHERIA CRIVELLINI SRL is a company with a single shareholder, with its registered office at Via Trieste no. 14, Bassano del Grappa 36061 - Italy, VAT and tax code IT 04433560242, and registration number with the Chamber of Commerce of Vicenza
1.2. The use of the remote sales service, governed by these General Sales Conditions, is reserved exclusively for consumers (hereinafter referred to as "Customer" or, in the plural, "Customers") understood as natural persons who act for purposes not related to their commercial, entrepreneurial, artisanal, or professional activity, who are over 18 years of age (or, if minors, authorized by their legal representative).
The resale or transfer of the products purchased on the Website for any commercial or professional purpose is expressly prohibited.
1.3. The products offered for sale on the Website can be delivered in Italy, in Europe, and anywhere else in the world where our shipping service is available, as specified in the "Shipping" section.
1.4. The language used for the conclusion of the sales contract through this Website is Italian and English.
1.5. These General Sales Conditions are published on the Website to allow their knowledge as well as storage and reproduction by the Customer in accordance with current legislation.
1.6. The purchase of products is governed exclusively by the General Sales Conditions published on the Website and in force at the time of purchase.
DROGHERIA CRIVELLINI reserves the right to make changes and/or additions to these General Sales Conditions at any time.
Any changes and/or additions will be effective solely in relation to purchases made after the date of publication of the new version of the General Sales Conditions.
The replacement of these General Sales Conditions with a new version implies the automatic inapplicability, ineffectiveness, and unenforceability against DROGHERIA CRIVELLINI of the same in relation to purchases made after their removal from the Website, even if these General Sales Conditions were still accessible to the public through other websites, different from the one mentioned above.
2. Availability of Products
2.1. The Customer acknowledges that the products offered by DROGHERIA CRIVELLINI on the Website (hereinafter referred to as the "Products") are numerically limited, and therefore, the availability of the Products will need to be verified by DROGHERIA CRIVELLINI at the time of purchase.
2.2. Inconveniences may occasionally occur regarding the availability of certain Products. In such cases, DROGHERIA CRIVELLINI will promptly inform the Customer via email.
2.3. DROGHERIA CRIVELLINI reserves the right to change the items offered for sale on the Website at any time, without notice.
2.4. Despite DROGHERIA CRIVELLINI's constant efforts to ensure that the photographs shown on the Website accurately reproduce the original products, some variations are always possible due to the technical features and color resolution of the Customer's device. Therefore, DROGHERIA CRIVELLINI will not be liable for any inadequacy of the graphic representations of the Products shown on the Website due to the aforementioned technical reasons.
2.5. In case of questions regarding the Products, the Customer, before placing an order, may contact DROGHERIA CRIVELLINI by sending an email to info@drogheriacrivellini.com.
3. Purchasing Procedure
3.1. Each Product offered for sale on the Website can be viewed through a specific link that allows you to see photographic images of the item, the unit price, colors, and available sizes (if any).
3.2. The Products chosen by the Customer will be added to a dedicated section (hereinafter referred to as the "Cart").
The description of the Products, including measurements or sizes (if any), along with one or more digital photographic images that allow a correct representation of the Products, will be included in the Customer's Cart.
3.3. To view the selected Products and the total price of the purchase order, it is necessary to access the Cart page.
Before confirming their order proposal (hereinafter referred to as the "Order Proposal"), the Customer is required to verify the accuracy of the Cart's contents and complete the purchase form according to the instructions provided on the Website.
3.4. The purchasing procedure is completed when the Customer selects the appropriate order confirmation button (hereinafter referred to as the "Purchase Button"), thus validating their Order Proposal, which will be sent directly to DROGHERIA CRIVELLINI.
After selecting the Purchase Button, the content of the Order Proposal cannot be modified by the Customer anymore.
3.5. Before confirming the Order Proposal, the Customer must declare that they have read and accepted the present General Sales Conditions. At the end of the purchasing procedure, it is advisable for the Customer to save or print the General Sales Conditions.
3.6. The purchasing procedure must be completed in its entirety; otherwise, the Order Proposal cannot be sent to DROGHERIA CRIVELLINI.
3.7. Each Order Proposal and the Customer's data necessary for the purchase will be stored by DROGHERIA CRIVELLINI for the period of time and in compliance with the conditions provided by current regulations.
Any use of the data for purposes other than the purchase will be subject to prior and express consent from the Customer, based on the conditions specified in the "Privacy Policy" published on the Website.
3.8. Customers who have registered in the reserved area of the Website can check the status of their order by accessing that area and entering the page related to their orders.
3.9. The Customer is aware of being responsible for the correctness and truthfulness of all data entered on the Website or used during the purchase phase
4. Contract Conclusion
4.1. Following the confirmation of the Order Proposal, the order is sent to DROGHERIA CRIVELLINI for processing and cannot be further modified or canceled. The Order Proposal issued by the Customer will be taken into account by DROGHERIA CRIVELLINI only if the entire purchasing procedure has been completed correctly, without any errors highlighted by the Website.
4.2. The contract concluded between DROGHERIA CRIVELLINI and the Customer shall be deemed concluded at the moment when the Customer receives one or more confirmation emails from DROGHERIA CRIVELLINI (hereinafter referred to as the "Confirmation Email"). The Confirmation Email will be sent to the address provided by the Customer in the purchase form and will contain the confirmation and summary of the conditions of the purchase, such as: the description of the Product and its main characteristics, the total price of the order, including any shipping costs, the address to submit any complaints, information on after-sales assistance services, the existence of the right of withdrawal, and the related exercise methods.
4.3. DROGHERIA CRIVELLINI reserves the right not to accept the Order Proposal issued by a Customer in the following cases:
a) Unavailability of the Products included in the Order Proposal.
b) Existence of a legal dispute between DROGHERIA CRIVELLINI and the Customer related to a previous order.
c) Previous violations of the General Sales Conditions by the Customer or failure to fulfill their obligations.
d) Evidence that the Customer purchases the Products with the purpose of reselling or transferring them for commercial or professional purposes.
e) Involvement or suspicion of illegal or fraudulent activities by the Customer.
In the above cases, DROGHERIA CRIVELLINI will notify the Customer via email within 30 (thirty) days from the date of actual receipt of the Order Proposal about the possible cancellation of the received orders. In such cases, no Order Proposal shall be deemed accepted by DROGHERIA CRIVELLINI, and no contract shall be deemed concluded between DROGHERIA CRIVELLINI and the Customer.
4.4. In case of partial availability of the ordered Product, the Customer will only be charged for the amount related to the Products actually purchased.
5. Price and Payment Method
5.1. The prices of all Products offered for sale on the Website are inclusive of VAT and are indicated in Euros, excluding the cost of shipping and any applicable customs duties in the destination country.
Customs fees and taxes may be applied to goods shipped to non-EU countries. These fees and taxes are calculated based on the value of the goods purchased and national guidelines of the destination country. The Customer is responsible for any and all such fees and taxes should they apply.
5.2. The total amount of the price shown in the Cart includes any shipping costs, which will be indicated separately. In any case, DROGHERIA CRIVELLINI will seek the explicit consent of the Customer for any possible additional supplementary cost, AS IN THE CASE WHERE AN EXPRESS OR DEDICATED SERVICE IS REQUESTED.
5.3. The prices published on the Website and shown in the Cart at the time of confirming the Order Proposal through the Customer's selection of the Purchase Button will be charged to the Customer, provided that the ordered Products are available at that time. DROGHERIA CRIVELLINI reserves the right to modify the prices of the Products offered for sale on the Website at any time and without prior notice.
5.4. DROGHERIA CRIVELLINI accepts payments exclusively through bank transfer, PayPal, and credit cards.
5.5. Payments for the products purchased on the DROGHERIA CRIVELLINI Website are processed through the PayPal system, and therefore, transactions can be made by the Customer with a credit card accepted by the aforementioned system or by transferring funds through a PayPal account. If the Customer does not have a PayPal account, they can create one on this occasion. After the authorization of the order by PayPal, the Customer will be redirected to DROGHERIA CRIVELLINI's confirmation page.
5.6. All credit card transactions are carried out using secure systems, and DROGHERIA CRIVELLINI does not retain any financial data of customers, especially credit card data.
5.7. For payment by credit card, the Customer confirms and guarantees that they are the holder of the credit card used for the purchase and that all data relating to it, entered during the purchase phase (such as the number, expiration date, and, if necessary, the security code), are correct. The transaction will be charged to the Customer only after: (i) verification of the credit card data and (ii) receipt of the debit authorization from the credit card company used by the Customer.
5.8. The shipment of purchased products will be made only after the payment of the amount due by the Customer has been successfully processed.
In the event that, for any reason, the charging of the amounts due from the Customer proves impossible, the sales process will be automatically canceled, and the sale will be cancelled as communicated to the Customer.
5.9. In the event that one or more Products are not available, only the price and any shipping costs related to the available Products will be charged.
6. Shipping and Delivery
6.1. At the beginning of the order process, the possible shipping times and options for the purchased Products and the chosen delivery country are indicated. The delivery times start from the order confirmation.
6.2. The delivery times of ordered products may vary depending on the availability in the warehouse and the destination address of the goods. All orders placed after 1:00 PM on Friday will be processed starting from the following Monday.
6.3. Customers will receive the Products separately as soon as they are ready for shipment. The Products will be shipped to the address provided by the Customer in the Order Proposal. At the time of delivery, no signature from the Customer will be required to receive the shipment.
6.4. For security reasons, DROGHERIA CRIVELLINI will not fulfill any order addressed to a P.O. Box and will not accept any order where it is not possible to identify the individual recipient of the order and their address.
6.5. The Products sold on the Website can only be delivered to the countries indicated by DROGHERIA CRIVELLINI. Therefore, any Order Proposals with shipments to be made outside of these countries will be considered by our staff during the order processing procedure, and the outcome will be communicated to the customer via email.
6.6. In cases where shipping costs are charged to the Customer, they will be expressly indicated separately from any other costs or expenses at the end of the Order Proposal compilation process and before the Customer selects the Purchase Button.
6.7. In accordance with the applicable law, the maximum period within which DROGHERIA CRIVELLINI must deliver the purchased Products is 30 (thirty) days from the date of conclusion of the contract, except for events of force majeure.
6.8. If DROGHERIA CRIVELLINI does not deliver the ordered Products within the aforementioned period, the Customer must request DROGHERIA CRIVELLINI to make the delivery within a supplementary appropriate period, in accordance with the applicable law. The Customer retains the right to immediately terminate the contract if the ordered Product is not delivered within the supplementary period indicated.
6.9. DROGHERIA CRIVELLINI shall have the right to divide the Order into multiple shipments based on the availability of the Products for delivery, and the Customer will receive the Products separately based on their availability.
6.10. At the time of shipment of the purchased Product, the Customer will receive an email at the address provided in the Order Proposal. This email will contain a tracking code for the shipment, allowing real-time monitoring of the delivery.
6.11. The Customer shall assume the risk of loss or damage to the Products only at the moment when the Customer, or a third party designated by the Customer and different from the carrier, physically takes possession of such Products.
In the event that, on the contrary, the loss or damage to the Product occurs before the material delivery to the Customer or a third party designated by the Customer, DROGHERIA CRIVELLINI will proceed to refund the Customer the amounts already paid.
6.12. Upon the arrival of the goods, customers are kindly requested to carefully inspect the package. DROGHERIA CRIVELLINI packages are carefully sealed with adhesive tape placed around the package.
If, for any reason, the package appears tampered with or if the adhesive tape is not intact, customers are requested to sign the receipt with a reservation or to refuse delivery. In the event of evidence of package tampering, customers are requested to immediately report the incident to the courier and to contact DROGHERIA CRIVELLINI via email at the following address: info@drogheriacrivellini.com.
Any dispute regarding damages, shortages, or delivery to the wrong address must be reported to DROGHERIA CRIVELLINI within a maximum of 5 days from the delivery date indicated on the courier's website; otherwise, it will not be accepted.
6.13. If the package is not delivered due to reasons dependent on the customer (wrong address, recipient consistently absent, incorrect phone number, etc.) or if the customer refuses delivery, the shipping costs and any customs duties will be deducted from the refund owed to the customer.
7. Product Compliance
7.1. At the time of delivery, the Customer must check the Products to ensure that they correspond to the items ordered and do not have any manufacturing defects or non-compliance issues. The sale of the Products is subject to the legal warranties provided by the current legislation, as well as any additional conventional warranties possibly provided to the Customer.
7.2. In the case of the existence of manufacturing defects or non-compliance issues, the Customer shall be entitled to have the Product restored to conformity, without any charges, through repair or replacement, unless the requested remedy is objectively impossible or excessively costly compared to the other option. If one of the circumstances provided by the law occurs, the Customer may request an appropriate price reduction or the termination of the contract and the consequent refund of the price paid. It is understood that the Customer loses this right if they do not report the non-compliance issue to DROGHERIA CRIVELLINI within 2 (two) months from the date on which they discovered the defect. In any case, DROGHERIA CRIVELLINI is responsible only for non-compliance issues that occur within 2 (two) years from the delivery of the Product. The action aimed at asserting non-compliance issues is time-barred within 26 (twenty-six) months from the delivery of the Product.
7.3. In order to report the presence of defects and non-compliance issues of the Products and obtain one of the remedies listed above, the Customer can contact DROGHERIA CRIVELLINI at the following email address: info@drogheriacrivellini.com.
8. Returns and Refunds - Right of Withdrawal
8.1. The Customer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery or receipt of the Products, except in the case of Customized Products.
8.2. To exercise the right of withdrawal, the Customer must first contact DROGHERIA CRIVELLINI by email to be sent to the address info@drogheriacrivellini.com. In doing so, the Customer may indicate the reasons for wanting to return the product, allowing DROGHERIA CRIVELLINI, excluding cases of mere reconsideration, to take all actions aimed at improving customer satisfaction.
The Customer cannot make any returns without first contacting our staff.

8.3. The shipping costs for the return and any responsibility for loss, theft, damage, or delay in delivery will be borne by the Customer.
8.4. The Customer agrees to return the Products for which they have exercised the right of withdrawal without undue delay and, in any case, within 14 (fourteen) days from the date on which they communicated to DROGHERIA CRIVELLINI their decision to withdraw from the contract.
8.5. The Products must be returned in the same condition in which they were delivered. The Customer must ensure that the Products are intact and complete, never used, worn, or damaged in any way, and that they are returned in their original packaging, complete with all the labels they were received with. In the case of a Product with a security label, the return of the Product will not be accepted if the original security label has been removed, broken, or tampered with.
8.6. DROGHERIA CRIVELLINI will verify the packaging and the condition of each individual returned Product, as the substantial integrity of the Products is an essential requirement for exercising the right of withdrawal. DROGHERIA CRIVELLINI reserves the right to refuse the return of those Products that are found to be damaged, deteriorated, soiled, or in a condition that unequivocally indicates that they have been used for purposes other than those strictly necessary for the Customer's checks to ascertain the nature and characteristics of the purchased Product. In case of refusal of the return, DROGHERIA CRIVELLINI will send a specific communication to the Customer and will not proceed with the refund of the price paid by the Customer, reserving the right to request compensation for any damage attributable to the Customer's conduct.
8.7. The refund of the price of the returned Products will be made by DROGHERIA CRIVELLINI without undue delay and in any case within 14 (fourteen) days from the date on which DROGHERIA CRIVELLINI became aware of the Customer's exercise of the right of withdrawal. In any case, DROGHERIA CRIVELLINI reserves the right to withhold the refund until it has received and verified the Product or until the Customer demonstrates that they have correctly returned the product in its original condition, taking into account the situation that occurs first. The aforementioned refund will be made by crediting the amount paid by the Customer using the same payment method used for the purchase unless the Customer has expressly agreed otherwise and provided that they do not incur any costs as a result of the refund. DROGHERIA CRIVELLINI will confirm the Customer's refund by email.
8.8. DROGHERIA CRIVELLINI will not be required to refund the delivery costs of the Products.
8.9. The return of the Products under this article is allowed only in relation to purchases made on the Website.
9. Limitation of Liability
9.1. Except in cases of willful misconduct or gross negligence, DROGHERIA CRIVELLINI will not be liable to the Customer for indirect or consequential damages that may arise from the purchase of Products offered for sale on the Website.
10. Authenticity of Products and Intellectual Property Rights
10.1. DROGHERIA CRIVELLINI guarantees the authenticity and high quality of all Products offered for sale on the Website.
10.2. The DROGHERIA CRIVELLINI trademark, as well as all other figurative and non-figurative trademarks, and more generally all other trademarks, illustrations, images, and logos present on the Products, their accessories, and/or packaging, whether registered or not, are and remain the exclusive property of DROGHERIA CRIVELLINI. Total or partial reproduction, modification, tampering, or use of these trademarks, illustrations, images, and logos, for any reason and on any medium, is strictly prohibited.
11. Disputes
11.1. These General Sales Conditions are governed by Italian law and will be interpreted in accordance with it, without prejudice to any different imperative, more favorable norm applicable in the country of habitual residence of the Customer.
11.2. In the event of a dispute arising from the interpretation and/or application of these General Sales Conditions, the court of the place of domicile or residence of the Customer, if located within the territory of the Italian State, will have exclusive and mandatory jurisdiction. If the Customer's domicile or residence is located in a territory other than the Italian State, the Customer may, at their choice, bring the action before the court of their place of residence or domicile or before the court of Vicenza.
Alternatively, the Customer may initiate one of the out-of-court dispute resolution procedures provided for by current legislation. To this end, the Customer can use the online platform made available by the European Commission, which can be accessed through the website http://ec.europa.eu/odr.
